Employers Must Comply with Healthy Workplaces Act

Employers in New Mexico must comply with the state’s Healthy Workplaces Act. To help employers understand their responsibilities, the New Mexico Department of Workforce Solutions will host a webinar at 2:00 pm on Tuesday, May 13, 2025.

The Healthy Workplaces Act of 2021 requires all private employers in New Mexico to allow employees to accrue and use earned sick leave. The law, which went into effect on July 1, 2022, lets employees earn and use up to 64 hours of sick leave per year. The earned sick leave is in addition to any paid time off provided by an employer. All businesses with at least one employee are subject to the Act, no matter the size of the company. Businesses that only engage independent contractors are not subject to the law.

The May 13 webinar, called Paid Sick Leave Rights, Responsibilities, and Compliance, is free to view; however, DWS has requested pre-registration.

Participants can expect to hear about the key aspects of the Act and learn about updates and changes since its implementation. Resources to assist businesses with compliance will also be discussed.

The May 13, 2025, webinar will review the rules and offer resources and an update about what has been learned since the law took effect.
